1. Introduction and Acceptance of Terms
Welcome to Maenam, a residential care community for seniors located in Lamphun, Thailand. These Terms and Conditions govern your use of our services and your relationship with Maenam. By using our website, scheduling a visit, or entering into a residency agreement, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
If you are entering into a residency agreement on behalf of a senior resident, you represent that you have the legal authority to do so and that both you and the resident agree to these terms.
These Terms and Conditions should be read in conjunction with our Privacy Policy and Cookie Policy, which are incorporated by reference.
2. Definitions
For the purposes of these Terms and Conditions:
- "Maenam," "we," "us," or "our" refers to the residential care community operating at 41/7 Moo 2, Rim Ping, Mueang Lamphun, Lamphun 51000, Thailand
- "Resident" refers to any senior individual receiving care services from Maenam
- "Family Member" or "Representative" refers to the individual who has legal authority to make decisions on behalf of a Resident
- "Services" refers to the residential care, accommodation, meals, activities, and support provided by Maenam
- "Agreement" refers to the residency contract entered into between Maenam and the Resident or their Representative
- "Website" refers to our online presence accessible at our domain
3. Eligibility and Admission
3.1 Age Requirement
Our services are designed for individuals aged 60 years and older. Admission is subject to an assessment to ensure that we can meet the prospective resident's needs within our care capabilities.
3.2 Care Assessment
Before admission, we conduct a comprehensive assessment of the prospective resident's physical, emotional, and social needs. This assessment helps us determine if our community is an appropriate fit and allows us to prepare for the resident's arrival.
3.3 Non-Medical Facility
Maenam is a residential care community, not a medical facility. We do not provide nursing care, medical treatments, or skilled medical services. Residents requiring ongoing medical care should maintain relationships with external healthcare providers.
3.4 Community Size
We maintain a maximum of eighteen residents to ensure personalized care and attention. Admission is subject to availability.
4. Services Provided
Maenam offers three primary service options, each with specific inclusions as detailed on our website and in individual agreements:
4.1 Riverside Day Retreat
A single-day experience including facility tour, shared meal, activity participation, and consultation with our director. This service does not constitute a residency arrangement.
4.2 Riverside Community Residency
Full-time residential care including accommodation, meals, daily living assistance, activities, and care companion support. Specific terms are outlined in the Residency Agreement.
4.3 River Pavilion Private Residence
Enhanced residential care with private suite, terrace, personal aide, and additional amenities. Specific terms are outlined in the Residency Agreement.
Services may be modified based on individual needs, availability, and operational requirements. We will communicate any significant changes to services with reasonable notice.
5. Payment Terms
5.1 Pricing
Our current pricing is as follows:
- Riverside Day Retreat: ฿8,200 per visit
- Riverside Community Residency: ฿31,000 per month
- River Pavilion Private Residence: ฿59,500 per month
Prices are subject to change with 90 days' written notice to existing residents.
5.2 Payment Schedule
Monthly fees for residency services are due on the first day of each month. Payment may be made by bank transfer, check, or other agreed methods. A deposit equivalent to one month's fee is required prior to move-in and will be refunded upon departure, subject to the conditions outlined in the Residency Agreement.
5.3 Late Payment
Payments not received within 10 days of the due date may incur a late fee of ฿1,000. Continued non-payment may result in termination of services as outlined in Section 9.
5.4 Additional Services
Services not included in the monthly fee, such as specialized transportation, personal shopping, or additional care support beyond our standard offerings, will be billed separately with prior agreement.
6. Resident and Family Responsibilities
6.1 Accurate Information
Families and residents must provide accurate, complete, and current information regarding health status, medications, dietary needs, emergency contacts, and any other relevant details necessary for appropriate care.
6.2 Communication
Families are responsible for maintaining regular communication with Maenam staff, attending scheduled meetings, and promptly responding to requests for information or decisions regarding the resident's care.
6.3 Respectful Conduct
All residents, family members, and visitors are expected to treat staff, other residents, and guests with respect and courtesy. Harassment, abusive language, or threatening behavior will not be tolerated.
6.4 Property Respect
Residents and their families are responsible for respecting community property and the personal belongings of other residents. Damage to property caused by negligence or intentional acts may result in repair or replacement costs.
7. Health and Safety
7.1 Medical Care Coordination
While we assist with coordinating healthcare appointments and transportation, residents and their families are responsible for maintaining relationships with external healthcare providers and ensuring appropriate medical care.
7.2 Emergency Situations
In the event of a medical emergency, we will contact emergency services and the resident's emergency contacts. We reserve the right to make decisions necessary to protect the resident's health and safety when family members cannot be immediately reached.
7.3 Medication Management
Our staff can provide reminders and assistance with medication administration, but we are not licensed to provide nursing care. Residents requiring complex medication management may need to arrange for visiting nursing services.
8. Visiting and Family Involvement
We maintain an open visiting policy during our operating hours (9:00 AM - 6:00 PM daily). Families are encouraged to visit regularly and participate in community activities and monthly family gatherings.
Extended visits outside of regular hours may be arranged in advance. We ask that families respect the privacy and routines of other residents when visiting.
9. Termination of Services
9.1 Termination by Family
Families may terminate residency with 30 days' written notice. The deposit will be refunded within 30 days after move-out, less any outstanding fees or charges for damages.
9.2 Termination by Maenam
We may terminate residency with 30 days' notice under the following circumstances:
- Resident's care needs exceed our non-medical care capabilities
- Failure to pay fees despite reasonable efforts to resolve the issue
- Behavior by the resident or family members that threatens the safety or wellbeing of staff or other residents
- Violation of these Terms and Conditions or the Residency Agreement
In cases of immediate safety concerns, we reserve the right to arrange alternative care with less notice while working with families to find appropriate solutions.
10. Limitation of Liability
While we take every reasonable precaution to ensure resident safety and wellbeing, we cannot provide absolute assurance against all accidents, injuries, or health complications that may occur.
Maenam's liability is limited to the direct damages caused by our proven negligence or willful misconduct. We are not liable for:
- Health complications or conditions that arise from pre-existing conditions or natural progression of age-related decline
- Injuries resulting from a resident's own actions or failure to follow staff guidance
- Loss or damage to personal property unless caused by our proven negligence
- Indirect, consequential, or punitive damages
Our total liability in any case shall not exceed the fees paid for services during the three months preceding the incident.
11. Intellectual Property
All content on our website, including text, images, logos, and design elements, is the property of Maenam or used with permission. You may not reproduce, distribute, or use this content without our express written permission.
12. Privacy and Data Protection
We are committed to protecting personal information in accordance with our Privacy Policy and Thailand's Personal Data Protection Act. Please refer to our Privacy Policy for detailed information on how we collect, use, and protect your data.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by the laws of Thailand. Any disputes arising from these terms or the services provided shall be resolved through the following process:
- Good faith negotiations between the parties
- If unresolved, mediation through a mutually agreed mediator
- If mediation fails, arbitration or litigation in the appropriate courts of Lamphun Province, Thailand
14. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be communicated through:
- Email notification to registered families
- Posted notice in the community
- Updated version on our website with a new "Last Updated" date
Continued use of our services after notification of changes constitutes acceptance of the modified terms. Significant changes affecting existing residency agreements will require written consent from families.
15. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these terms, and the remaining provisions shall continue in full force and effect.
